These Terms of Service govern your use of JCMNJ websites, services, projects, software, communications, and related digital tools.

By using JCMNJ services, submitting a form, requesting work, approving a project, or continuing to use a JCMNJ website or service, you agree to these Terms.

About JCMNJ

JCMNJ is the public brand of James Carver Marketing LLC.

JCMNJ provides practical digital services including websites, software, automation, AI-assisted workflows, digital preservation, community guides, operational systems, creative projects, consulting, and related communications.

JCMNJ works with businesses, organizations, families, and communities to bring practical digital projects to life.

Services

JCMNJ services may include:

  • Website planning, design, review, or development
  • Software tools and operational systems
  • Automation and workflow support
  • AI-assisted tools and guidance
  • Digital preservation projects
  • Community guides and local information systems
  • Creative and content projects
  • Consulting, advisory, and project guidance
  • Reports, audits, recommendations, or roadmaps
  • Communications, reminders, updates, and support

The exact scope, timeline, pricing, and deliverables for any service may be defined separately through a proposal, invoice, written agreement, email, project brief, or other written communication.

Advisory and Informational Nature

Many JCMNJ services involve observations, recommendations, reports, guidance, or practical digital support. Unless expressly agreed in writing, JCMNJ services are advisory, operational, creative, and informational in nature.

JCMNJ does not guarantee specific business results, search rankings, revenue, traffic, leads, customer conversion, platform performance, or third-party outcomes.

Client Responsibilities

Clients and users are responsible for:

  • Providing accurate information
  • Supplying needed materials, access, approvals, and feedback
  • Reviewing deliverables
  • Making final business decisions
  • Confirming legal, regulatory, or compliance requirements specific to their business
  • Maintaining ownership and access to accounts, platforms, domains, hosting, and third-party services they control
  • Ensuring they have the right to use any submitted content, images, documents, trademarks, or materials

Project Materials and Content

If you submit files, images, documents, data, credentials, business information, or other materials to JCMNJ, you represent that you have the right to provide and use those materials.

You grant JCMNJ permission to use submitted materials as reasonably necessary to provide the requested services, complete the project, maintain records, and support related business operations.

JCMNJ is not responsible for claims arising from materials provided by a client or user without proper rights, permissions, or authorization.

Third-Party Services

JCMNJ services may rely on third-party platforms, tools, APIs, websites, hosting providers, analytics systems, payment processors, email providers, SMS providers, AI tools, automation services, machine learning systems, open-source software, cloud platforms, social platforms, external vendors, or other external services.

JCMNJ is not responsible for failures, outages, policy changes, price changes, feature changes, availability changes, data limitations, access restrictions, or performance issues caused by third-party services.

Temporary outages, API limitations, permission changes, platform updates, or account issues may affect service delivery or reporting completeness.

AI-Assisted Services

JCMNJ may use AI-assisted tools, automation, machine learning systems, open-source software, third-party APIs, cloud platforms, and external vendors to support drafting, analysis, automation, organization, design, research, or workflow development.

AI-assisted outputs may require human review. JCMNJ does not guarantee that AI-assisted outputs will be error-free, complete, or suitable for every use without review.

Clients remain responsible for final approval and use of materials, content, or decisions based on AI-assisted work.

Payments

Payment terms may be stated in an invoice, proposal, checkout page, written agreement, or other written communication.

Unless otherwise agreed:

  • One-time services are due at purchase or before work begins
  • Subscription or recurring services bill on the stated cycle
  • Late, failed, or missed payments may result in delayed, paused, or canceled service
  • Taxes, processing fees, or third-party costs may be the client’s responsibility where applicable

Cancellations and Refunds

Cancellation terms may vary by service.

Unless otherwise agreed in writing:

  • One-time diagnostic, creative, advisory, or project services are generally non-refundable once work has begun or deliverables have been provided
  • Subscription services may be canceled before the next billing cycle
  • Cancellation stops future billing but does not automatically refund completed billing periods
  • Custom project deposits or milestone payments may be non-refundable depending on work completed
  • Any exception is at JCMNJ’s discretion unless otherwise required by law

Communications

JCMNJ may communicate by email, phone, SMS, website forms, project tools, or other reasonable channels.

Privacy

Acceptable Use

You agree not to misuse JCMNJ websites, services, forms, software, or communications. Prohibited activity includes:

  • Attempting unauthorized access
  • Interfering with security or operations
  • Submitting unlawful, harmful, deceptive, or infringing content
  • Using JCMNJ services for spam, abuse, fraud, harassment, or illegal activity
  • Copying, reselling, or misusing JCMNJ systems or materials without permission

JCMNJ may suspend or terminate access for misuse, nonpayment, unlawful conduct, abusive behavior, or activity that interferes with service delivery.

Intellectual Property

Clients retain ownership of their own logos, photos, content, business data, trademarks, and materials they provide to JCMNJ.

Unless otherwise agreed in writing, JCMNJ retains ownership of its pre-existing tools, systems, frameworks, reusable code, prompt libraries, AI workflows, templates, design patterns, internal processes, platform concepts, documentation, and business methods.

Client-specific final deliverables may be assigned or licensed according to the applicable proposal, invoice, agreement, or written project scope.

JCMNJ may reuse general knowledge, skills, ideas, methods, non-confidential workflows, and reusable technology developed through its work.

Portfolio and Project References

Unless a written confidentiality agreement or NDA states otherwise, JCMNJ may reference completed work, client names, project descriptions, public links, and non-confidential screenshots in its portfolio, proposals, marketing materials, or case studies. JCMNJ will not intentionally publish confidential client information.

No Warranty

JCMNJ services are provided on an “as is” and “as available” basis to the maximum extent permitted by law.

JCMNJ makes no guarantee that services will be uninterrupted, error-free, or produce a specific outcome.

Limitation of Liability

To the maximum extent permitted by law, JCMNJ shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.

JCMNJ shall not be liable for lost profits, lost revenue, lost data, lost business opportunity, business interruption, third-party platform failure, or outcomes outside JCMNJ’s direct control.

To the maximum extent permitted by law, JCMNJ’s total liability for any claim shall not exceed the amount paid by the client to JCMNJ for the specific service giving rise to the claim during the three months before the claim.

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.

Disputes

Any dispute related to JCMNJ services, websites, projects, software, communications, or these Terms will be handled through the appropriate state or federal courts located in New Jersey, unless otherwise required by law.

Changes to These Terms

JCMNJ may update these Terms from time to time. Continued use of JCMNJ websites, services, or communications after updated Terms are posted constitutes acceptance of the revised Terms.
